    Rep. Leah S. Paquiz joins the Department of Labor and Employment in recent hospital inspections to look into the condition of health workers as a duly trained and appointed Labor inspector and Social partner. Through Administrative Order No. 36, series of 2018, Labor Secretary Bello has issued the general authority to DOLE’s Social Partners to participate in the inspection of enterprises for compliance with labor standards. Evidences received through both formal and anonymous letters sent to ANG NARS Legal Assis-tance Program led to the inspection of hospitals in Nueva Ecija and Metro Manila. This is an excerpt of the report of ANG NARS received by DOLE on May 22, 2018: “The DOLE inspection report on Guimba Medical Center dated 27 September 2017 rendered multiple and repeated violations of the general labor standards such as, 48 working hours, 12 days duty for every 15 days, non-payment of rest day premium, non-issuance of payslip, and non-payment of overtime work, lack of employment contract. Sad to say, until this time, DOLE RO III has not given any update nor compliance report on the actions taken by GMC and the actions of the DOLE RO III.

    On the Makati Medical Center DOLE NCR Inspection Report, we found out multiple violations of the general labor standards. In our interviews with the health workers, I found out that all the health workers are given probationay periods of five months and on the sixth month, they are made regular workers. To my surprise and dismay, it was only the nurses who were given false trainings of one (1) month (the other batches served for three months), paid P10, 000.00 and was not paid of their services. Pharmacists are required to give P1, 000.00 bond to be refunded 2 years thereafter. Non-presentation of Service Agreement for 3 sub-contractors, thus the following findings:

    A. ON GENERAL LABOR STANDARDS

    1. There is a P1,000.00 bond for pharmacists
    2. No uniform provided for probationary employees
    3. CARE training for nurses as a requisite for hiring with P10,000.00 training fee. CARE deductions for the month of March 2018 affecting 14 employees. There is no proof of approval of training from the Professional Regulation Commission, Board of Nursing.
    4. Non-presentation of service agreements for 3 subcontractors/ There is a con-tractual employee for twenty (20) years assigned by sub-contrator Facilites Manager Inc.,
    5. Non-payment of overtime rendered for endorsement and charting of nurses

    B. ON OCUCUPATIONAL SAFETY AND HEALTH STANDARDS

    1. There is no Fire safety Inspection certificate for Towers 1 and 2

    On the other hand, the submitted Compliance Report of Makati Medical Center dated April 24, 2018, on its corrective measures taken, thus:

    1. MMC has refunded this 23 April 2018 to all affected Care Trainees a total amount of P2,190,828.75;
    2. The training bong of P1,000.00 posted by the 18 pharmacist were refunded;
    3. All 162 probationary employees whose uniform expense were personally shouldered by them were are paid in full by MMC”

    This is very good news for nurses and health workers as this is solid evidence in DOLE’s commitment in the implementation of DO182-17 “Guidelines Governing the Employment and Working Conditions of Health Personnel in the Private Healthcare Industry”.
